A BILL
To prevent 340B covered entities from using savings derived for sex
reassignment surgeries, hormonal therapies, and for other purposes.
Be it enacted by the Senate and House of Representatives of the
United States of America in Congress assembled,
SECTION 1. SHORT TITLE.
This Act may be cited as the ``No 340B Savings for Transgender Care
Act''.
SEC. 2. PROHIBITION ON USE OF 340B SAVINGS FOR SERVICES DESCRIBED FOR
TRANSGENDER INDIVIDUALS.
(a) Prohibition on Use of 340B Savings for Services Described.--
Section 340B(a)(4) of the Public Health Service Act (42 U.S.C.
256b(a)(5)) is amended by adding at the end the following:
``(E) Prohibition on use of 340b savings for
services described.--A covered entity participating in
the program under this section may not use any funds
derived from the difference between the 340B ceiling
price and the actual acquisition cost of covered
outpatient drugs to pay for services described.
``(i) Definitions.--For purposes of this
subsection--
``(I) Covered entity.--The term
`covered entities' has the meaning
given such term in section 340B(a)(4).
``(II) Services described.--The
term `services described' means--
``(aa) sex reassignment
surgeries furnished for the
purpose of the gender
alteration of a transgender
individual; and
``(bb) hormone treatments
furnished for the purpose of
the gender alteration of a
transgender individual.''.
