                                 A BILL


 
   To amend title 49, United States Code, to provide eligibility for 
   projects to develop and implement regenerative braking and energy 
  storage technologies under the consolidated rail infrastructure and 
          safety improvements program, and for other purposes.

    Be it enacted by the Senate and House of Representatives of the 
United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

    This Act may be cited as the ``Battery and Regenerative Braking 
Act''.

SEC. 2. CONSOLIDATED RAIL INFRASTRUCTURE AND SAFETY IMPROVEMENTS.

    Section 22907 of title 49, United States Code, is amended by adding 
at the end the following:
    ``(m) Additional Eligible Entities and Projects.--In addition to 
the eligibility provided in subsections (b) and (c), an entity 
providing commuter rail passenger transportation, as defined in section 
24102, shall be eligible under this section for projects to develop and 
implement regenerative braking and energy storage technologies.''.
