                                 A BILL


 
    To amend title 18, United States Code, by adding an additional 
 aggravating factor to be considered in determining whether a sentence 
                         of death is warranted.

    Be it enacted by the Senate and House of Representatives of the 
United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

    This Act may be cited as the ``Justice for American Victims of 
Illegal Aliens Act''.

SEC. 2. DEATH PENALTY AGGRAVATING FACTORS.

    Section 3592(c) of title 18, United States Code, is amended by 
inserting after paragraph (16) the following:
            ``(17) Illegal alien.--The defendant is an alien who--
                    ``(A) came to, entered, or remains in the United 
                States in violation of Federal law; and
                    ``(B) has been convicted of killing, attempting to 
                kill, or conspiring to kill a United States citizen.''.
