and referred to the Committee on Environment and Public Works

A BILL
To amend the Federal Water Pollution Control Act to clarify that a
permit is not required under the National Pollutant Discharge
Elimination System for a discharge resulting from the aerial
application of certain products used for fire control and suppression,
and for other purposes.
Be it enacted by the Senate and House of Representatives of the
United States of America in Congress assembled,
SECTION 1. SHORT TITLE.
This Act may be cited as the ``Forest Protection and Wildland
Firefighter Safety Act of 2025''.
SEC. 2. LIMITATION ON PERMIT REQUIREMENT.
Section 402(l)(3) of the Federal Water Pollution Control Act (33
U.S.C. 1342(l)(3)) is amended--
(1) in subparagraph (A)--
(A) by striking ``this section for a discharge
from'' and inserting the following: ``this section
for--
``(i) a discharge from'';
(B) in clause (i) (as so designated), by striking
the period at the end and inserting ``; or''; and
(C) by adding at the end the following:
``(ii) a discharge resulting from the
aerial application of a product used for fire
control and suppression purposes that appears
on the most current applicable Qualified
Products List maintained by the Forest Service
(or any successor list).''; and
(2) in subparagraph (C)--
(A) by striking ``(C) The authorization'' and
inserting the following:
``(C) Applicability.--The authorization'';
(B) by striking ``Section 505(a)'' and inserting
``section 505(a)'';
(C) by striking ``402(p)(6)'' and inserting
``subsection (p)(6)''; and
(D) by striking ``402(l)(3)(A)'' each place it
appears and inserting ``subparagraph (A)''.
