  To amend title 23, United States Code, to modify the percentage of 
    highway safety program funds required to be spent by political 
                 subdivisions, and for other purposes.

    Be it enacted by the Senate and House of Representatives of the 
United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

    This Act may be cited as the ``Rural Safety Administration 
Flexibility Act''.

SEC. 2. HIGHWAY SAFETY PROGRAMS.

    Section 402(b) of title 23, United States Code, is amended--
            (1) in paragraph (1)(C), by inserting ``(or, in the case of 
        a rural State, 20 percent)'' after ``40 percent''; and
            (2) by adding at the end the following:
            ``(3) Definition of rural state.--In this subsection, the 
        term `rural State' means any State, the population density of 
        which is below the national average (as determined based on 
        data from the most recent decennial Census).''.
