Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, SECTION 1. SHORT TITLE. This Act may be cited as the ``Rural Safety Administration Flexibility Act''. SEC. 2. HIGHWAY SAFETY PROGRAMS. Section 402(b) of title 23, United States Code, is amended-- (1) in paragraph (1)(C), by inserting ``(or, in the case of a rural State, 20 percent)'' after ``40 percent''; and (2) by adding at the end the following: ``(3) Definition of rural state.--In this subsection, the term `rural State' means any State, the population density of which is below the national average (as determined based on data from the most recent decennial Census).''. <all>
