A BILL
To authorize the Secretary of Health and Human Services to destroy
adulterated, misbranded, or counterfeit tobacco products offered for
import.
Be it enacted by the Senate and House of Representatives of the
United States of America in Congress assembled,
SECTION 1. SHORT TITLE.
This Act may be cited as the ``Ensuring the Necessary Destruction
of Illicit Chinese Tobacco Act'' or the ``END Illicit Chinese Tobacco
Act''.
SEC. 2. DESTRUCTION OF ADULTERATED, MISBRANDED, OR COUNTERFEIT TOBACCO
PRODUCTS OFFERED FOR IMPORT.
(a) In General.--Section 801(a) of the Federal Food, Drug, and
Cosmetic Act (21 U.S.C. 381(a)) is amended--
(1) in the fourth sentence, by striking ``or counterfeit
device'' and inserting ``, counterfeit device, or counterfeit
tobacco product (as defined in section 900)''; and
(2) by striking ``drug or device'' each place it appears in
the seventh, eighth, ninth, and tenth sentences and inserting
``drug, device, or tobacco product''.
(b) Applicability.--The amendments made by subsection (a) shall
apply beginning on the date of enactment of this Act.
