Amendment provides that elements proved to convict a defendant of an offense may be considered as aggravating factors in determining whether or not to impose a death sentence; eliminates life imprisonment without parole as an alternative sentence for specific crimes; and mandates that a death sentence be imposed in certain circumstances.

Purpose:

An amendment to specify that elements that must be proved to convict a defendant of an offense (such as premeditation) may be considered factors in determining whether or not to impose a death sentence. The amendment would also delete the provisions of the bill which require juries to be instructed that they are never required to impose a death sentence, and eliminates life imprisonment without parole as an alternative sentence for specific crimes.
