hospice care.

A BILL
To amend title XVIII of the Social Security Act to provide for coverage
of expanded respite care services for medicare beneficiaries receiving
hospice care.
  Be it enacted by the Senate and House of Representatives of the United
  States of America in Congress assembled,
SECTION 1. SHORT TITLE.
  This Act may be cited as the `Medicare Hospice In-Home Respite Care Coverage
  Act of 1991'.
SEC. 2. COVERAGE OF EXPANDED RESPITE CARE FOR MEDICARE BENEFICIARIES RECEIVING
HOSPICE CARE.
  (a) IN GENERAL-
  (1) COVERAGE- Section 1861(dd)(1) of the Social Security Act (42
  U.S.C. 1395x(dd)(1)) is amended--
  (A) by striking `and' at the end of subparagraph (G);
  (B) by striking the period at the end of subparagraph (H) and inserting
  `, and'; and
  (C) by adding at the end the following new subparagraph:
  `(I) in-home respite care provided over a continuous period of not less than
  5 hours, except that payment may not be made for more than 40 hours of such
  care during any of the 90-day periods or the subsequent 30-day period during
  which payment may be made for hospice care under part A of this title.'.
  (2) PAYMENT- Section 1814(i)(1) of such Act (42 U.S.C. 1395f(i)(1)) is
  amended by adding at the end the following new subparagraph:
  `(D)(i) With respect to in-home respite care furnished during fiscal year
  1991, the payment rate shall be $90 for each 5-hour period of continuous
  care (increased by $10 for each additional hour of the period during which
  such care is continuously provided) or a rate provided under a fee schedule
  determined by the Secretary, whichever is lower.
  `(ii) With respect to in-home respite care furnished during a subsequent
  fiscal year, the payment rate shall be the payment rate in effect under
  this subparagraph during the previous fiscal year increased by the market
  basket percentage increase (as defined in section 1886(b)(3)(B)(iii))
  otherwise applicable to discharges occurring in the fiscal year.'.
  (b) EFFECTIVE DATE- The amendments made by subsection (a) shall apply with
  respect to respite care furnished on or after October 1, 1991.
