Mr. KLUG (for himself, Mr. DOOLITTLE, Mr. PETRI, Mr. PALLONE, Mr. GRANDY,
Mr. ROEMER, Mr. BOEHNER, Mr. DREIER of California, Mr. FRANK of Massachusetts,
Mr. MARLENEE, Mr. ABERCROMBIE, and Mr. CUNNINGHAM) introduced the following
bill; which was referred to the Committee on Public Works and Transportation
A BILL
To amend title 23, United States Code, to modify requirements that States
have in effect laws requiring the use of motorcycle helmets.
  Be it enacted by the Senate and House of Representatives of the United
  States of America in Congress assembled,
SECTION 1. SHORT TITLE.
  This Act may be cited as the `Motorcycle Rider Responsibility Act of 1992'.
SEC. 2. AMENDMENTS TO PROGRAM REQUIRING USE OF MOTORCYCLE HELMETS.
  (a) ELIGIBILITY FOR GRANTS- Section 153(a) of title 23, United States Code,
  is amended--
  (1) in paragraph (1) by striking `if any individual on the motorcycle
  is not wearing a motorcycle helmet; and' and inserting `by a covered
  individual who is not wearing a motorcycle helmet and by any individual
  whenever there is a passenger under age 21 on the motorcycle who is not
  wearing a motorcycle helmet;';
  (2) in paragraph (2) by striking the period at the end and inserting `;
  and'; and
  (3) by adding at the end the following new paragraph:
  `(3) a law requiring that any individual under age 21 complete a motorcycle
  safety rider course before being issued a motorcycle operator's license.'.
  (b) SECOND-YEAR GRANTS- Section 153(f)(2) of such title is amended--
  (1) by striking `and' at the end of subparagraph (A);
  (2) by striking the period at the end of subparagraph (B) and inserting
  `; and'; and
  (3) by adding at the end the following new subparagraph:
  `(C) had in effect at all times a State law described in subsection (a)(3).'.
  (c) THIRD-YEAR GRANTS- Section 153(f)(3) of such title is amended--
  (1) by striking `and' at the end of subparagraph (A);
  (2) by striking the period at the end of subparagraph (B) and inserting
  `; and'; and
  (3) by adding at the end the following new subparagraph:
  `(C) had in effect at all times a State law described in subsection (a)(3).'.
  (d) PENALTY- Paragraphs (1) and (2) of section 153(h) of such title are
  amended by striking `and a law described in subsection (a)(2)' each place
  it appears and inserting `, a law described in subsection (a)(2), and a
  law described in subsection (a)(3)'.
  (e) COVERED INDIVIDUAL DEFINED- Section 153(i) of such title is amended--
  (1) by redesignating paragraphs (2), (3), and (4) as paragraphs (3),
  (4), and (5), respectively; and
  (2) by inserting after paragraph (1) the following new paragraph:
  `(2) COVERED INDIVIDUAL- The term `covered individual' means any individual
  under age 21 and any individual who has been licensed to operate a motorcycle
  for less than 2 full calender years.'.
SEC. 3. EFFECTIVE DATE.
  The amendments made by section 2 shall take effect on the first day of
  the first fiscal year beginning after the date of the enactment of this Act.
