To amend the Social Security Act to increase the limit on  Federal matching
funds available for the medicaid program in Puerto Rico and to make
improvements in the furnishing of and payment for equipment and related
supplies furnished to medicare beneficiaries.

Mr. COLORADO (for himself, Mr. RANGEL, Mr. SCHEUER, Mr. TOWNS, Mr. SERRANO,
and Mr. RICHARDSON) introduced the following bill; which was jointly referred
to the Committees on Ways and Means and Energy and Commerce
A BILL
To amend the Social Security Act to increase the limit on  Federal matching
funds available for the medicaid program in Puerto Rico and to make
improvements in the furnishing of and payment for equipment and related
supplies furnished to medicare beneficiaries.
  Be it enacted by the Senate and House of Representatives of the United
  States of America in Congress assembled,
SECTION 1. SHORT TITLE.
  This Act may be cited as the `Puerto Rico Medicaid Improvement Act of 1992'.
SEC. 2. INCREASE IN LIMIT ON FEDERAL MEDICAID MATCHING IN PUERTO RICO.
  Section 1108(c)(1) of the Social Security Act (42 U.S.C. 1308(a)(1))
  is amended--
  (1) by striking `and' after `1989', and
  (2) by striking `(and each succeeding fiscal year)' and inserting `,
  and $104,000,000 for fiscal year 1993 (and each succeeding fiscal year).'.
SEC. 3. PARENTERAL AND ENTERAL NUTRITION NUTRIENTS, SUPPLIES, AND EQUIPMENT.
  (a) PARENTERAL AND ENTERAL NUTRITION NUTRIENTS, AND SUPPLIES-
  (1) Section 1834(h) of the Social Security Act (42 U.S.C. 1395m(h))
  is amended--
  (A) in paragraph (1)(B)(ii), by inserting `or (4)' after `(2)';
  (B) in paragraph (2) in the matter preceding subparagraph (A), by inserting
  `(other than parenteral and enteral nutrition nutrients and supplies)'
  after `prosthetic devices'; and
  (C) by redesignating paragraph (4) as paragraph (5) and inserting after
  paragraph (3) the following:
  `(4) PURCHASE PRICE FOR PARENTERAL AND ENTERAL NUTRITION NUTRIENTS AND
  SUPPLIES- For purposes of paragraph (1), the amount that is recognized
  under this paragraph as the purchase price for parenteral and enteral
  nutrition nutrients and supplies is--
  `(A) for an item furnished in 1993 (or in a later year in which an item
  is first available), the amount specified in a national fee schedule
  developed by the Secretary, based on the lower of the 25th percentile of
  actual charges (if ascertainable) for the item or a national payment rate
  derived from wholesale, retail, and other price information, or
  `(B) for an item furnished after 1993 (other than in a year in which an
  item is first available), the amount determined under this paragraph for the
  previous year increased by the applicable percentage increase for the year.'.
  (2)(A) Section 1834(h)(5) of such Act (as redesignated by paragraph (1)(C)
  of this subsection) is amended--
  (i) in subparagraph (B), by striking `parenteral and enteral nutrition
  nutrients, supplies, and equipment' and inserting `intraocular lenses or
  medical supplies (including catheters, catheter supplies, ostomy bags,
  and supplies related to ostomy care) furnished by a home health agency
  under section 1861(m)(5)', and
  (ii) by amending subparagraph (C) to read as follows:
  `(C) the term `orthotics and prosthetics' means the items described in
  section 1861(s)(9).'.
  (B) Section 1861(s)(8) of such Act (42 U.S.C. 1395x(s)(8)) is amended by
  striking `colostomy' each place it appears and inserting `ostomy'.
  (b) PARENTERAL AND ENTERAL NUTRITION EQUIPMENT-
  (1) The first sentence of section 1861(n) of such Act (42 U.S.C. 1395x(n))
  is amended--
  (A) by striking `and' after `hospital beds,',
  (B) by inserting `, and parenteral and enteral nutrition equipment' after
  `may prescribe)', and
  (C) by inserting `(except with respect to parenteral and enteral nutrition
  equipment)' after `used as his home other than'.
  (2) Section 9340 of the Omnibus Budget Reconciliation Act of 1986 is
  repealed.
  (3) Section 6112(b) of the Omnibus Budget Reconciliation Act of 1989
  is repealed.
  (4) The payment amount recognized under section 1834(a) of the Social
  Security Act for parenteral and enteral nutrition equipment furnished
  in 1993 shall be the average reasonable charge for the 12-month period
  ending on December 31, 1991, increased by the percentage increase in the
  Consumer Price Index for All Urban Consumers (United States city average)
  for the 24-month period ending with June 1992.
  (c) EFFECTIVE DATE- The amendments made by this section shall apply to
  items furnished after 1992.
SEC. 4. ASPIRATORS AND NEBULIZERS.
  (a) GENERAL RULE- Section 1834(a)(3)(A) of the Social Security Act (42
  U.S.C. 1395m(a)(3)(A)) is amended by striking `, aspirators, IPPB machines,
  and nebulizers' and inserting `and IPPB machines'.
  (b) EFFECTIVE DATE- The amendment made by subsection (a) applies to items
  furnished after 1992.
