To amend title 38, United States Code, to make the Equal Access to Justice
Act applicable to the United States Court of Veterans Appeals.

Mr. EDWARDS of California (for himself, Mr. EVANS, and Mr. NAGLE) introduced
the following bill; which was referred to the Committee on Veterans' Affairs
A BILL
To amend title 38, United States Code, to make the Equal Access to Justice
Act applicable to the United States Court of Veterans Appeals.
  Be it enacted by the Senate and House of Representatives of the United
  States of America in Congress assembled,
SECTION 1. APPLICABILITY OF EQUAL ACCESS TO JUSTICE ACT TO COURT OF VETERANS
APPEALS.
  (a) IN GENERAL- Section 7263 of title 38, United States Code, is amended
  by adding at the end the following new subsection:
  `(e) Section 2412 of title 28 shall apply to any proceeding before the
  Court.'.
  (b) EFFECTIVE DATE- Subsection (e) of section 7263 of title 38, United
  States Code, as added by subsection (a), shall not apply with respect to
  any proceeding before the United States Court of Veterans Appeals for which
  the decision of the court became final before the date of the enactment
  of this Act.
