tobacco products.

A BILL
To amend section 615 of title 38, United States Code, to require the Secretary
of Veterans Affairs to permit persons who receive care at medical facilities
of the Department of Veterans Affairs to have access to and to consume
tobacco products.
  Be it enacted by the Senate and House of Representatives of the United
  States of America in Congress assembled,
SECTION 1. SHORT TITLE.
  This Act may be cited as the `Veterans Dignity in Health Care Act of 1991'.
SEC. 2. FINDINGS AND PURPOSE.
  (a) FINDINGS- Congress finds that it is in the interest of the public that
  the Secretary of Veterans Affairs--
  (1) provide hospital care, nursing home care, and domiciliary care to
  veterans in medical facilities of the Department of Veterans Affairs in
  a manner that takes into account the personal freedom, dignity, and self
  respect of such veterans; and
  (2) give priority to the personal needs and interests in privacy of such
  veterans in the provision of such care in such facilities.
  (b) PURPOSE- It is the purpose of this Act to ensure that hospital care,
  nursing home care, and domiciliary care are provided to veterans in medical
  facilities of the Department in a manner which takes into account the needs,
  concerns, personal freedoms, and dignity of such veterans.
SEC. 3. ENTITLEMENT OF VETERANS TO ACCESS TO AND CONSUMPTION OF TOBACCO
PRODUCTS.
  (a) ENTITLEMENT- (1) Section 615 of title 38, United States Code, is
  amended to read as follows:
` 615. Availability and use of tobacco products
  `(a) The Secretary shall, in regulations prescribed by the Secretary,
  ensure that any veteran who is furnished hospital care, nursing home care,
  or domiciliary care under section 610(a) of this title in a Department
  facility shall be entitled (in accordance with medical requirements and
  limitations applicable to the veteran or the facility) to purchase and
  consume tobacco products.
  `(b) In prescribing regulations under subsection (a), the Secretary shall
  ensure that--
  `(1) the Department facilities that maintain a commissary or canteen make
  tobacco products available for purchase in the commissary or canteen;
  `(2) veterans being furnished care in such facilities are provided access
  to the commissary or canteen;
  `(3) such facilities maintains a suitable indoor area for the consumption
  of tobacco products; and
  `(4) such veterans have access to that area for the purpose of consuming
  tobacco products.'.
  (2) The item relating to section 615 in the table of sections at the
  beginning of chapter 17 of title 38, United States Code, is amended to
  read as follows:
`615. Availability and use of tobacco products.'.
  (b) IMPLEMENTATION- The regulations referred to in section 615(a) of such
  title (as amended by subsection (a)) shall take effect not later than 60
  days after the date of the enactment of this Act.
