Mr. Nadler introduced the following bill; which was referred jointly to

                                 A BILL


 
To amend the Asbestos School Hazard Abatement Act of 1984 and title II 
  of the Toxic Substances Control Act to expand the coverage of those 
      Acts to include Head Start Programs, and for other purposes.

    Be it enacted by the Senate and House of Representatives of the 
United States of America in Congress assembled,

SECTION 1. SHORT TITLE

    This Act may be cited as the ``Head Start Safety Act''.

SEC. 2. EXPANSION OF COVERAGE OF ASHAA.

    Section 511 of title V of the Education for Economic Security Act 
(the Asbestos School Hazard Abatement Act of 1984) (20 U.S.C.4011 and 
following) is amended as follows:
            (1) In paragraph (4) strike ``and'' at the end of 
        subparagraph (A), strike the period at the end of subparagraph 
        (B) and insert ``; and'' and add the following at the end 
        thereof:
                            ``(C) any Head Start Agency designated 
                        under the Head Start Act (42 U.S.C. 9831 and 
                        following).''
            (2) In paragraph (6) strike ``and'' at the end of 
        subparagraph (C), strike the period at the end of subparagraph 
        (D) and insert ``; and'' and add the following at the end 
        thereof:
                            ``(E) any facility used for a Head Start 
                        Program assisted under the Head Start Act (42 
                        U.S.C. 9831 and following).''.

SEC. 3. EXPANSION OF COVERAGE OF TOXIC SUBSTANCES CONTROL ACT

    (a) Head Start Programs.--Section 202 of the Toxic Substances 
Control Act is amended as follows:
            (1) In paragraph (7) strike ``and'' at the end of 
        subparagraph (B), strike the period at the end of subparagraph 
        (C) and insert ``; and'' and add the following at the end 
        thereof:
                            ``(D) any Head Start Agency designated 
                        under the Head Start Act (42 U.S.C. 9831 and 
                        following).''
            (2) In paragraph (13) strike ``and'' at the end of 
        subparagraph (C), strike the period at the end of subparagraph 
        (D) and insert ``; and'' and add the following at the end 
        thereof:
                            ``(E) any facility used for a Head Start 
                        Program assisted under the Head Start Act (42 
                        U.S.C. 9831 and following).''.
    (b) Effective Dates.--(1) Title II of the Toxic Substances Control 
Act is amended by adding the following new section at the end thereof:

``SEC. 217. EFFECTIVE DATE FOR HEAD START PROGRAMS.

    ``In the case of any local educational agency which is a Head Start 
Agency referred to in section 202(7)(D), for purposes of applying the 
provisions of this title applicable to school buildings described in 
section 202(13)(E), the references in this title to the date of 
enactment of this title shall be treated as references to the date of 
the enactment of this section.''.
    (2) The table of contents for such title is amended by adding the 
following new section at the end thereof:

``Sec. 217. Effective date for head start programs.''.
    (c) Regulations.--Within 180 days after the enactment of this Act, 
the Administrator shall amend the regulations promulgated under title 
II of the Toxic Substances Control Act to reflect the amendments made 
by subsection (a) of this section.
