SECTION 1. SHORT TITLE; REFERENCES.

    (a) Short Title.--This Act may be cited as the ``National Wildlife 
Refuge System Management and Policy Act of 1994''.
    (b) References.--Whenever in this Act an amendment or repeal is 
expressed in terms of an amendment to, or repeal of, a section or other 
provision, the reference shall be considered to be made to a section or 
provision of the National Wildlife Refuge System Administration Act of 
1966 (16 U.S.C. 668dd et seq.).

SEC. 2. FINDINGS AND PURPOSES.

    (a) Findings.--Congress finds that--
            (1) the National Wildlife Refuge System (referred to in 
        this section as the ``System'') was established under the 
        National Wildlife Refuge System Administration Act of 1966 (16 
        U.S.C. 668dd et seq.);
            (2) such Act consolidates the authorities for the System 
        related to lands, waters, and interests in the lands and 
        waters, administered by the Secretary of the Interior, that 
        promote the conservation of fish and wildlife;
            (3) the System provides opportunities for individuals to 
        participate in fish- and wildlife-dependent recreation, and to 
        learn, understand, and appreciate the value of and need for 
        conserving fish and wildlife, wild lands, and productive 
        ecological communities, types, and systems;
            (4) the System is the only complex of Federal lands devoted 
        primarily to preserving, restoring, and managing fish and 
        wildlife and the habitats of fish and wildlife;
            (5) national wildlife refuges provide habitat for many 
        endangered and threatened species, and for species that may 
        become endangered or threatened, as well as for other fish, 
        wildlife, and plants;
            (6) the well-being and abundance of fish, wildlife, and 
        plants would be diminished without the protected habitat within 
        the System;
            (7) activities are occurring on a significant number of 
        national wildlife refuges that are detrimental to the fish, 
        wildlife, and plants that the System was designed to conserve; 
            (8) improvements are needed in the administration and 
        management of the System to ensure that sound and effective 
        conservation programs for the System are developed, 
        implemented, and enforced;
            (9) the System and other Federal lands do not now 
        adequately conserve the diversity of the ecosystems of the 
        United States and the species and habitats of the ecosystems;
            (10) proper management of the System is part of, and should 
        be integrated with, nationwide efforts to conserve and manage 
        fish and wildlife resources;
            (11) the States are critical to the conservation and 
        management of the fish, wildlife, and plants of the United 
        States, and their habitats; and
            (12) the protection and restoration of the ecological 
        integrity of the System and units of the System require 
        effective coordination, interaction, and cooperation with 
        surrounding owners of land, the fish and wildlife agency of the 
        State in which the unit of the System is located, local 
        governments, and other entities other than the United States 
        Fish and Wildlife Service.
    (b) Purposes.--The purposes of this Act are--
            (1) to reaffirm the provisions of Public Law 87-714 
        (commonly known as the ``Refuge Recreation Act'') (16 U.S.C. 
        460k et seq.) that authorize the Secretary of the Interior to 
        permit compatible fish- and wildlife-dependent public 
        recreation, such as hunting, fishing, and wildlife observation, 
        on refuges;
            (2) to improve the administration and management of the 
        System;
            (3) to establish purposes for the System;
            (4) to improve the compatibility determination process for 
        the System;
            (5) to enhance comprehensive planning for the System and 
        individual wildlife refuges of the System; and
            (6) to provide for interagency coordination in conserving 
        refuge resources.

SEC. 3. DEFINITIONS.

    (a) In General.--Section 5 (16 U.S.C. 668ee) is amended--
            (1) by redesignating subsection (a) as subsection (d);
            (2) by redesignating subsection (b) as subsection (k);
            (3) by redesignating subsection (c) as subsection (i) and 
        moving such subsection to appear after subsection (d) (as 
        redesignated by paragraph (1));
            (4) by inserting before subsection (d) (as redesignated by 
        paragraph (1)) the following new subsections:
    ``(a) The term `Coordination Area' as used in this Act means an 
area listed in table 5, entitled `Coordination Areas', of the report 
entitled `Annual Report of Lands under Control of the United States 
Fish and Wildlife Service as of September 30, 1994'.
    ``(b) The term `Director' as used in this Act means the Director of 
the United States Fish and Wildlife Service.
    ``(c) The terms `fish', `wildlife', and `fish and wildlife' as used 
in this Act mean any wild member of the animal kingdom whether alive or 
dead, and regardless of whether the member was bred, hatched, or born 
in captivity, including a part, product, egg, or offspring of the 
member.'';
            (5) by inserting before subsection (i) (as redesignated and 
        moved by paragraph (3)) the following new subsections:
    ``(e) The term `plant' as used in this Act means any member of the 
plant kingdom in a wild, unconfined state, including any plant 
community, seed, root, or other part of a plant.
    ``(f) The terms `purposes of the refuge', and `primary purposes and 
functions of the refuge', as used in this Act mean the purposes, and 
primary purposes and functions, respectively, specified in or derived 
from the law, proclamation, executive order, agreement, public land 
order, donation document, or administrative memorandum establishing, 
authorizing, or expanding a refuge, refuge unit, or refuge subunit, and 
any subsequent modification of the original establishing authority for 
additional conservation purposes.
    ``(g) The term `refuge' as used in this Act means a designated area 
of land, water, or an interest in land or water within the System, 
except that the term does not include a Coordination Area.
    ``(h) The term `Secretary' as used in this Act means the Secretary 
of the Interior (except as the context implies otherwise).''; and
            (6) by inserting before subsection (k) (as redesignated by 
        paragraph (2)) the following new subsection:
    ``(j) The term `System' as used in this Act means the National 
Wildlife Refuge System.''.
    (b) Conforming Amendment.--Section 4 (16 U.S.C. 668dd) is amended 
by striking ``Secretary of the Interior'' each place it appears and 
inserting ``Secretary''.

SEC. 4. MISSION AND PURPOSES OF THE SYSTEM.

    Section 4(a) (16 U.S.C. 668dd(a)) is amended--
            (1) by redesignating paragraphs (2) and (3) as paragraphs 
        (6) and (7), respectively;
            (2) in clause (i) of paragraph (7) (as so redesignated), by 
        striking ``paragraph (2)'' and inserting ``paragraph (6)''; and
            (3) by inserting after paragraph (1) the following new 
        paragraphs:
    ``(2) The overall mission of the System is to conserve and manage 
fish, wildlife, and plants of the United States and their habitats for 
the benefit of present and future generations.
    ``(3) The purposes of the System are--
            ``(A) to provide a diverse national network of lands and 
        waters designed to conserve and manage, in perpetuity, native 
        fish, wildlife, and plants of the United States and their 
        habitats;
            ``(B) to conserve, manage, and where appropriate restore 
        fish and wildlife populations, plant communities, and refuge 
        habitats so as to provide in perpetuity for the diversity of 
        native fish, wildlife, and plants and the ecological processes 
        that sustain them; and
            ``(C) to conserve and manage migratory birds, anadromous or 
        interjurisdictional fish species, marine mammals, and other 
        fish, wildlife, and plants.
    ``(4) In addition, the purposes of numerous units within the System 
are--
            ``(A) to preserve, restore, and recover fish, wildlife, and 
        plants that are listed as threatened or endangered species or 
        are candidates for listing under section 4 of the Endangered 
        Species Act of 1973 (16 U.S.C. 1533) and the ecosystems on 
        which the species depend;
            ``(B) to fulfill international treaty obligations of the 
        United States with respect to fish, wildlife, and plants, and 
        their habitats; and
            ``(C) to provide opportunities, as appropriate, for fish- 
        and wildlife-dependent recreation and environmental education, 
        if the recreation or education is compatible with the purposes 
        of the particular refuge with respect to which the Secretary 
        authorizes the recreation and education and the purposes of the 
        System specified in paragraph (3), and is consistent with sound 
        scientific principles of fish and wildlife management.''.

SEC. 5. ADMINISTRATION OF THE SYSTEM.

    Section 4(a) (16 U.S.C. 668dd(a)) (as amended by section 4) is 
further amended by inserting after paragraph (4) the following new 
paragraph:
    ``(5) In administering the System, the Secretary shall--
            ``(A) ensure that the mission and purposes of the System 
        described in paragraphs (2) and (3) and the purposes of each 
        refuge are carried out, except that if a conflict exists 
        between the primary purposes of a refuge and any purpose of the 
        System, the conflict shall be resolved in a manner that first 
        fulfills the primary purposes of the refuge, and, to the extent 
        practicable, also achieves the purposes of the System;
            ``(B) protect each individual refuge and the System from 
        threats to the ecological integrity of the refuge and the 
        System;
            ``(C) assist in the maintenance of adequate water quantity 
        and water quality to fulfill the purposes of the System and the 
        purposes of each refuge; and 
            ``(D) plan, propose, and direct the expansion of the System 
        in the manner that is best designed to accomplish the purposes 
        of the System and the purposes of each refuge and to contribute 
        to the conservation of the ecosystems of the United States.''.

SEC. 6. COMPATIBILITY STANDARDS AND PROCEDURES.

    Section 4(d) (16 U.S.C. 668dd(d)) is amended by adding at the end 
the following new paragraphs:
    ``(3)(A) Effective beginning on the date that is 2 years after the 
date of enactment of this paragraph, the Secretary shall not initiate 
or permit a new use of a refuge or expand, renew, or extend an existing 
allowed use unless and until the Secretary determines that the use is 
compatible with the primary purposes of the refuge and the purposes of 
the System specified in subsection (a)(3). The Secretary may make the 
determination concurrently with the development of a conservation plan 
for the refuge under subsection (f).
    ``(B) Not later than 18 months after the date of enactment of this 
paragraph, the Secretary shall issue final regulations establishing the 
process for determining compatibility under subparagraph (A) that--
            ``(i) designate the refuge officer initially responsible 
        for compatibility determinations;
            ``(ii) require, with respect to each compatibility 
        determination, that the time, duration, location, manner, and 
        purpose of the use be specified;
            ``(iii) specify the biological and ecological criteria to 
        be used in making compatibility determinations, and the method 
        by which the beneficial and adverse effects of a use will be 
        considered;
            ``(iv) require that compatibility determinations be made in 
        writing, be based on the best available scientific information, 
        and represent the best professional judgment of the refuge 
        officer;
            ``(v) define as a compatible use a use that will not have a 
        detrimental effect on the fulfillment of the primary purposes 
        of the refuge or the purposes of the System specified in 
        subsection (a)(3);
            ``(vi) with respect to each recreational use not directly 
        related to the primary purposes and functions of the refuge, 
        require that a determination be made that funds are available 
        for the development, operation, and maintenance of the use 
        pursuant to Public Law 87-714 (commonly known as the `Refuge 
        Recreation Act') (16 U.S.C. 460k et seq.) before permitting the 
        use;
            ``(vii) provide for the expedited consideration of each use 
        that is likely to have no detrimental effect on the fulfillment 
        of the primary purposes of the refuge or the purposes of the 
        System specified in subsection (a)(3);
            ``(viii) provide for the elimination or modification of any 
        incompatible use as expeditiously as practicable after the 
        determination is made that the use is not compatible;
            ``(ix) require reevaluation of each then current use when 
        conditions under which the use is permitted change 
        significantly or when there is significant new information 
        regarding the effects of the use, but not less frequently than 
        once every 10 years, to ensure that the use remains compatible 
        with the primary purposes of the refuge and the purposes of the 
        System specified in subsection (a)(3); and
            ``(x) provide an opportunity for public review and comment 
        on each evaluation or reevaluation of a use, unless opportunity 
        for public review and comment on the use has been provided 
        during public involvement associated with the development or 
        revision of a conservation plan for the refuge under subsection 
        (f).
    ``(4)(A) To the extent practicable, each Federal agency shall 
minimize and mitigate the adverse effects on the resources of a refuge, 
identified during the compliance of the agency with the National 
Environmental Policy Act of 1969 (42 U.S.C. 4321 et seq.), that result 
from activities that the agency authorizes, funds, or conducts.
    ``(B) When a Federal agency is notified by the Secretary that the 
actions of the agency are having an adverse effect on the resources of 
a refuge, that is not identified during the compliance of the agency 
with the National Environmental Policy Act of 1969 (42 U.S.C. 4321 et 
seq.), the agency shall, to the extent practicable, take appropriate 
actions to minimize and mitigate the adverse effects on the resources 
of the refuge.
    ``(5) In the case of a refuge, or a portion of a refuge, over which 
a Federal agency other than the United States Fish and Wildlife Service 
holds primary jurisdiction, the provisions of this Act relating to 
determinations of compatibility shall not apply to activities 
authorized, funded, or conducted by the agency. Management of lands 
described in the preceding sentence shall be in accordance with the 
memoranda of understanding governing the use of the lands.
    ``(6)(A) The provisions of this Act relating to determinations of 
compatibility shall not apply to--
            ``(i) an activity within the airspace over a refuge;
            ``(ii)(I) a Federal navigation or communication aid that 
        exists on any refuge on the date of enactment of this paragraph 
        or on lands at the time the lands are subsequently added to the 
        System; and
            ``(II) the routine maintenance of, established access to, 
        and replacement of the aid if replacement of the aid has no 
        greater impact on wildlife resources than the original aid and 
        utilizes no more land; and
            ``(iii) a highway right of way, in existence on the date of 
        enactment of this paragraph, within any refuge and routine 
        maintenance of the right of way if, to the maximum extent 
        practicable, the right of way is managed and maintained so as 
        to be compatible with the purposes of the refuge.
    ``(B) Military use of the airspace at the Cabeza Prieta National 
Wildlife Refuge in Arizona and Desert National Wildlife Range in Nevada 
shall not be subject to the compatibility requirements of this Act and 
shall be governed by the memoranda of understanding, or amendments or 
revisions to the memoranda, referred to in the Military Lands 
Withdrawal Act of 1986 (Public Law 99-606; 100 Stat. 3457).
    ``(C) To the extent not already so provided with respect to 
airspace at the Desert National Wildlife Range and Cabeza Prieta 
National Wildlife Refuge and ground uses of lands at the Desert 
National Wildlife Range identified in paragraph (7)(A), the memoranda 
referred to in subparagraph (B) shall include provisions permitting the 
Secretary to identify reasonable terms and conditions to minimize or 
mitigate adverse impacts on refuge resources from Department of Defense 
activities.
    ``(7)(A) Primary jurisdiction over the lands within the Desert 
National Wildlife Range that are contained within the bombing range 
portion of Nellie Air Force Range, as depicted on a map entitled, 
`Desert NWR Lands to be transferred to Department of Defense', dated 
June 1994, is transferred to the Secretary of Defense for use in aerial 
training activities. The lands referred to in the preceding sentence 
may also be utilized for bombing and other aerial-related ground 
impacts.
    ``(B) The Secretary of the Interior shall retain secondary 
jurisdiction over the lands transferred pursuant to subparagraph (A) 
for the purpose of wildlife conservation.
    ``(8)(A) Subject to subparagraph (B) and notwithstanding any other 
provision of law, the Secretary of Defense--
            ``(i) not later than 3 years after the date of enactment of 
        this paragraph, shall identify to the Secretary of the Interior 
        and to the Committees on Armed Services of Congress lands or 
        interests in lands held by the Department of Defense that are 
        acceptable to the Secretary of the Interior for use as an 
        overlay refuge or inclusion in the System; and
            ``(ii) not later than 5 years after the date of enactment 
        of this paragraph, shall transfer the lands or interests in the 
        lands to the Secretary of the Interior.
    ``(B) Lands or interests in lands transferred pursuant to 
subparagraph (A)(ii) shall be approximately equal in acreage to the 
lands transferred pursuant to paragraph (7)(A). The Secretary of the 
Interior may accept lands transferred pursuant to subparagraph (A), if 
the Secretary finds that the lands to be transferred would better serve 
the purposes of the System.''.

SEC. 7. SYSTEM CONSERVATION PLANNING PROGRAM.

    (a) In General.--Section 4 (16 U.S.C. 668dd) is amended--
            (1) by redesignating subsections (e) through (i) as 
        subsections (g) through (k), respectively; and
            (2) by inserting after subsection (d) the following new 
        subsections:
    ``(e)(1) The Secretary shall--
            ``(A) not later than September 30, 2004--
                    ``(i) propose a comprehensive plan for the System 
                (referred to in this subsection as the `System plan'); 
                and
                    ``(ii) issue a final System plan;
            ``(B) not less frequently than 10 years after the date of 
        issuance under subparagraph (A)(ii) and every 10 years 
        thereafter, revise the System plan; and
            ``(C) publish a notice of opportunity for public comment in 
        the Federal Register on the proposed System plan and any 
        revision of the System plan.
    ``(2) The System plan shall be consistent with this Act and shall--
            ``(A) be designed to achieve the mission and purposes of 
        the System and to facilitate accomplishment of the purposes of 
        the individual refuges;
            ``(B) contain an analysis of various management 
        alternatives for the System;
            ``(C) set forth a strategy for maintaining healthy and 
        abundant fish, wildlife, and plant populations in the System, 
        including a conservation strategy for such endangered, 
        threatened, and candidate species for listing under section 4 
        of the Endangered Species Act of 1973 (16 U.S.C. 1533), and the 
        ecosystems upon which the species depend, as are located on 
        lands or waters within the System;
            ``(D) include a plan and program for the acquisition of 
        lands and waters necessary to achieve the purposes of the 
        System and each refuge and to contribute to the conservation of 
        the ecosystems of the United States, including estimates of the 
        additional costs to acquire, maintain, and manage the proposed 
        acquisitions; and
            ``(E) discuss the extent to which the purposes of the 
        System and the strategies developed pursuant to the System plan 
        can be achieved through conservation plans for refuges 
        developed under subsection (f).
    ``(3) The Secretary shall manage the System in a manner consistent 
with the System plan.
    ``(f)(1)(A) Except with respect to refuge lands in Alaska (which 
shall be governed by the refuge planning provisions of the Alaska 
National Interest Lands Conservation Act (16 U.S.C. 3101 et seq.)), the 
Secretary shall--
            ``(i) propose a comprehensive conservation plan (referred 
        to in this subsection as a `conservation plan') for each 
        refuge, ecologically related complex, or administratively 
        related complex of refuges (referred to in this subsection as a 
        `planning unit') in the System;
            ``(ii) publish a notice of opportunity for public comment 
        in the Federal Register on each proposed conservation plan;
            ``(iii) issue a final conservation plan for each planning 
        unit; and
            ``(iv) not less frequently than 15 years after the date of 
        issuance of a conservation plan under clause (iii) and every 15 
        years thereafter, revise the conservation plan.
    ``(B) The Secretary shall manage each planning unit in a manner 
consistent with the conservation plan for the unit and shall revise a 
conservation plan at any time if the Secretary determines that 
conditions that affect a planning unit have changed significantly.
    ``(2) In developing each conservation plan under this subsection, 
the Secretary, acting through the Director, shall identify and 
describe--
            ``(A) the purposes of each refuge that is the subject of 
        the conservation plan and the mission and purposes of the 
        System applicable to the refuge or the individual refuges of 
        the planning unit;
            ``(B) the distribution, migration patterns, and abundance 
        of fish, wildlife, and plant populations and the diversity of 
        habitats and natural communities within a planning unit;
            ``(C)(i) the ecological relationship between the planning 
        unit and surrounding lands; and
            ``(ii) opportunities to work with other agencies, States, 
        adjacent landowners, and other private or governmental 
        entities, to conserve planning units and the ecosystems in 
        which the planning units are located;
            ``(D) the archaeological and cultural values of the 
        planning unit;
            ``(E) such areas within the planning unit as are suitable 
        for use as administrative sites or visitor facilities and the 
        relationship between the areas and sensitive fish, wildlife, 
        and plant habitats within the planning unit;
            ``(F) significant problems, including problems relating to 
        water quantity and quality, that may affect the diversity, 
        natural communities, health, or abundance of populations or 
        habitats of fish, wildlife, and plants within the planning unit 
        and the specific actions necessary to avoid or overcome the 
        problems;
            ``(G) uses currently allowed and uses the Secretary 
        proposes to allow within the planning unit, including--
                    ``(i) a description of the preferred location of 
                the uses based on the avoidance of sensitive habitats 
                and populations, and on any other administrative 
                factors; and
                    ``(ii) the determination of the compatibility of 
                the uses, or if such a determination has not been made 
                with respect to a particular use, the manner and 
                schedule by which the Secretary shall make the 
                determination;
            ``(H) then current or proposed strategies to manage and 
        enhance fish, wildlife, and plant populations and the habitats 
        of the populations within the planning unit, including 
        strategies to promote the conservation and recovery of species 
        that are listed as threatened or endangered, or candidates for 
        the listings, under section 4 of the Endangered Species Act of 
        1973 (16 U.S.C. 1533) and the ecosystems upon which the species 
        depend;
            ``(I) the manner in which the management of the refuge will 
        contribute to the achievement of strategies identified in the 
        System plan prepared under subsection (e); and
            ``(J) the opportunities that may be available in the 
        planning unit for fish- and wildlife-dependent recreation, 
        ecological research, environmental education, interpretation of 
        the resources and values of the planning unit, and uses that 
        may contribute to refuge management.
    ``(3)(A) Except with respect to refuges in Alaska reviewed pursuant 
to section 1317 of the Alaska National Interest Lands Conservation Act 
(16 U.S.C. 3205), in carrying out this section, the Secretary shall--
            ``(i) review the suitability for designation as wilderness 
        such refuge lands (including lands described in subparagraph 
        (B)) as were not previously studied for designation as 
        wilderness or designated as wilderness; and
            ``(ii) recommend to the President and Congress designation 
        for the lands in accordance with subsections (c) and (d) of 
        section 3 of the Wilderness Act (16 U.S.C. 1132).
    ``(B) The lands referred to in subparagraph (A) include--
            ``(i) islands and areas of 200 acres or more immediately 
        adjacent to wilderness areas (as designated at the time of the 
        review);
            ``(ii) lands recommended (before the time of the review) 
        for inclusion in the Wilderness Preservation System established 
        under such Act; and
            ``(iii) lands that through acquisition total approximately 
        5,000 acres or more at the time of the review.
    ``(4)(A) In preparing each conservation plan under this subsection, 
and any revision of a conservation plan, the Secretary, acting through 
the Director, shall, to the maximum extent practicable and consistent 
with this Act--
            ``(i) consult with other adjacent or potentially affected 
        Federal, State, and private landowners as well as affected 
        State conservation agencies; and
            ``(ii) coordinate the development of the conservation plan 
        or revision of the plan with State comprehensive plans for fish 
        and wildlife in the State in which the refuge is located.
    ``(B) In the preparation and revision of a conservation plan under 
this subsection, coordination with State fish and wildlife agency 
personnel shall not be subject to the Federal Advisory Committee Act (5 
U.S.C. App. 2).
    ``(5)(A) In accordance with subparagraph (B), the Secretary shall 
develop and implement a process to ensure an opportunity for active 
public involvement in the preparation and revision of conservation 
plans under this subsection. At a minimum, the Secretary shall require 
that publication of any final plan shall include a summary of the 
comments made by adjacent or potentially affected landowners, local 
governments, and any other affected parties, together with a statement 
of the disposition of their concerns.
    ``(B) Prior to the adoption of each conservation plan, the 
Secretary shall issue public notice of the draft proposed conservation 
plan, make copies of the conservation plan available at the affected 
field and regional offices of the United States Fish and Wildlife 
Service, and provide opportunity for public comment.
    ``(6) Not later than 1 year after the date of enactment of this 
paragraph, the Secretary shall--
            ``(A) evaluate all refuge plans in existence on the date of 
        enactment of this paragraph to determine if the plans satisfy 
        this subsection; and
            ``(B) prepare and submit to the appropriate committees of 
        Congress--
                    ``(i) a list of acceptable plans; and
                    ``(ii) a proposed schedule for the revision of 
                existing refuge plans or development of new 
                conservation plans under which conservation plans for 
                all refuges and planning units will be completed not 
                later than 10 years after the date of enactment of this 
                paragraph.
    ``(7) The Secretary shall--
            ``(A) not later than 10 years after the date of enactment 
        of this paragraph, pursuant to this subsection and in 
        accordance with the schedule prepared pursuant to paragraph 
        (6)(B)(ii), revise or develop a plan for each refuge in 
        existence on the date of enactment of this paragraph; and
            ``(B) annually submit, to the appropriate committees of 
        Congress, a record of the progress of the United States Fish 
        and Wildlife Service in completing the plans.
    ``(8) With respect to any refuge established after the date of 
enactment of this paragraph, the Secretary shall prepare a conservation 
plan for the refuge or planning unit not later than 2 years after the 
Secretary has determined that sufficient land has been acquired to 
warrant comprehensive planning.''.

SEC. 8. EMERGENCY POWER.

    (a) Secretarial Authority.--Notwithstanding any other provision of 
this Act or the amendments made by this Act, the Secretary of the 
Interior may suspend, allow, or initiate any activity in a refuge in 
the National Wildlife Refuge System in the event of any emergency that 
constitutes an imminent danger to the health and safety of the public 
or any wildlife population.
    (b) Presidential Authority.--
            (1) Exemption.--The President is authorized to exempt from 
        any provision of this Act or an amendment made by this Act any 
        activity conducted by the Department of Defense on a refuge 
        within the National Wildlife Refuge System if the President 
        finds that--
                    (A) the activity is in the paramount interest of 
                the United States for reasons of national security; and
                    (B) there is no feasible and prudent alternative 
                location on public lands for the activity.
            (2) Mitigation.--After the President authorizes an 
        exemption under paragraph (1), the Secretary of Defense shall 
        undertake, with the concurrence of the Secretary of the 
        Interior, appropriate steps to mitigate the effect of the 
        exempted activity on the refuge.

SEC. 9. STATUTORY CONSTRUCTION.

    Except as specifically provided in this Act or the amendments made 
by this Act, nothing in this Act or the amendments made by this Act 
shall be construed so as to alter or otherwise affect--
            (1) Public Law 87-714 (commonly known as the ``Refuge 
        Recreation Act'') (16 U.S.C. 460k et seq.);
            (2) the National Wildlife Refuge System Administration Act 
        of 1966 (16 U.S.C. 668dd et seq.);
            (3) the Alaska National Interest Lands Conservation Act (16 
        U.S.C. 3101 et seq.);
            (4) the Federal Water Pollution Control Act (33 U.S.C. 1251 
        et seq.);
            (5) sections 88 and 89 of title 14, United States Code;
            (6) the Comprehensive Environmental Response, Compensation, 
        and Liability Act of 1980 (42 U.S.C. 9601 et seq.); or
            (7) any other law or order establishing an individual 
        refuge in effect on the date of enactment of this Act.

SEC. 10. REGULATIONS.

    Except as otherwise required in this Act, the Secretary of the 
Interior shall--
            (1) not later than 1 year after the date of enactment of 
        this Act, propose regulations to carry out this Act and the 
        amendments made by this Act; and
            (2) not later than 18 months after the date of enactment of 
        this Act, issue final regulations to carry out this Act and the 
        amendments made by this Act.

SEC. 11. PROTECTION OF WATER RIGHTS.

    Nothing in this Act or the amendments made by this Act shall create 
a reserved water right, express or implied, in the United States for 
any purpose.

SEC. 12. AUTHORIZATION OF APPROPRIATIONS.

    There are authorized to be appropriated such sums as are necessary 
to carry out this Act and the amendments made by this Act.
