                                 A BILL


 
  To amend the Omnibus Crime Control and Safe Streets Act of 1968 to 
   reduce certain funds if eligible States do not enact certain laws.

    Be it enacted by the Senate and House of Representatives of the 
United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

    This Act may be cited as the ``Crime Does Not Pay Act of 1998''.

SEC. 2. GRANT REDUCTION FOR NONCOMPLIANCE

    (a) Grant Reduction for Noncompliance.--Section 506 of title I of 
the Omnibus Crime Control and Safe Streets Act of 1968 is amended by 
adding at the end the following:
    ``(g) Prevention of Recovery for Injuries Incurred In Commission of 
Felonies.--
            ``(1) In general.--The funds available under this subpart 
        for a State shall be reduced by 5 percent and redistributed 
        under paragraph (2) unless, on the first day of each fiscal 
        year succeeding the first fiscal year beginning after September 
        30, 1999, the State has in effect throughout the State a law 
        which prohibits any individual who has been convicted of a 
        felony from recovering, in any civil action under the law or 
        such State, any compensatory, actual, or general damages for 
        any physical or mental injury, harm, or suffering to such 
        individual that was caused in the commission of the felony.
            ``(2) Redistribution.--Any funds available for 
        redistribution shall be redistributed, in accordance with 
        subsection (a), to participating States that have in effect a 
        law referred to in paragraph (1).
            ``(3) Compliance.--The Attorney General shall issue 
        regulations to ensure compliance with the requirements of 
        paragraph (1).
    (b) Conforming Amendment.--Section 506(a) of title I of the Omnibus 
Crime Control and Safe Streets Act of 1968 is amended by striking 
``subsection (f),'' and inserting ``subsections (f) and (g),''.
