To amend the Occupational Safety and Health Act of 1970 to provide that 
   the Act will not apply to employment performed with an electronic 
       device in a workplace located in the employee's residence.

     Mr. Davis of Virginia (for himself and Mr. Moran of Virginia) 
 introduced the following bill; which was referred to the Committee on 
                      Education and the Workforce

                                 A BILL


 
To amend the Occupational Safety and Health Act of 1970 to provide that 
   the Act will not apply to employment performed with an electronic 
       device in a workplace located in the employee's residence.

    Be it enacted by the Senate and House of Representatives of the 
United States of America in Congress assembled,

SECTION 1. APPLICATION OF OCCUPATIONAL SAFETY AND HEALTH ACT OF 1970.

    Section 4(b) of the Occupational Safety and Health Act of 1970 (29 
U.S.C. 653(b)) is amended by adding at the end the following:
    ``(5) Nothing in this Act shall apply to employment performed in a 
workplace through the use of a telephone, computer, or other electronic 
device which is located in the residence of the employee engaged in 
such employment.''.
