                                 A BILL


 
To amend the National Trails System Act to require that property owners 
    be compensated when certain railbanked trails are developed for 
            purposes of public use, and for other purposes.

    Be it enacted by the Senate and House of Representatives of the 
United States of America in Congress assembled,

SECTION 1. COMPENSATION FOR PUBLIC USE OF RAILBANKED TRAILS.

    Section 8(d) of the National Trails System Act (16 U.S.C. 1247(d)) 
is amended by inserting ``(1)'' after ``(d)'' and by adding the 
following at the end thereof:
    ``(2) Whenever any right-of-way is subject to the interim use 
provisions of paragraph (1), no such right-of-way may be developed for 
purposes of public use as a trail unless fair and reasonable 
compensation for such use has been tendered to the person to whom such 
right-of-way would revert upon abandonment for railroad purposes.''
