  To amend title VI of the Clean Air Act with respect to the phaseout 
                      schedule for methyl bromide.

  Aderholt) introduced the following bill; which was referred to the 
                         Committee on Commerce

                                 A BILL


 
  To amend title VI of the Clean Air Act with respect to the phaseout 
                      schedule for methyl bromide.

    Be it enacted by the Senate and House of Representatives of the 
United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

    This Act may be cited as the ``Methyl Bromide Fairness Act of 
2000''.

SEC. 2. PHASEOUT SCHEDULE FOR METHYL BROMIDE.

    Section 604 of the Clean Air Act (42 U.S.C. 7671c), as amended by 
section 764 of the Agriculture, Rural Development, Food and Drug 
Administration, and Related Agencies Appropriations Act, 1999 (as 
contained in section 101(a) of division A of Public Law 105-277; 112 
Stat. 2681, 2681-36), is amended--
            (1) in subsection (d), by amending paragraph (5) to read as 
        follows:
            ``(5) Sanitation and food protection.--Notwithstanding any 
        other provision of this title, the production, importation, and 
        consumption of methyl bromide to fumigate commodities or 
        articles or facilities where such commodities or articles may 
        be processed or stored for purposes of compliance with Animal 
        and Plant Health Inspection Service requirements or with any 
        international, Federal, State, or local sanitation or food 
        protection standard shall be exempt.''; and
            (2) by amending subsection (h) to read as follows:
    ``(h) Methyl Bromide.--Notwithstanding section 602(d), section 606, 
or subsection (b) or (d) of this section, the Administrator shall not 
terminate production of methyl bromide prior to January 1, 2015. The 
Administrator shall promulgate rules for reductions in, and terminate 
the production, importation, and consumption of, methyl bromide under a 
schedule that is in accordance with, but not more stringent than, the 
phaseout schedule of the Montreal Protocol for developing countries as 
described in Article 5 of such Protocol.''.
