    To amend title XVIII of the Social Security Act to increase the 
 proportion of charges Medicare recognizes for mental health services 
furnished to qualified Medicare beneficiaries who reside in congregate 
                              residences.

 Mr. Greenwood (for himself, Mr. Deutsch, Mr. Burr of North Carolina, 
Mr. Strickland, Mr. Tauzin, Mr. McGovern, Mrs. Johnson of Connecticut, 
 and Ms. Kaptur) introduced the following bill; which was referred to 
the Committee on Commerce, and in addition to the Committee on Ways and 
 Means, for a period to be subsequently determined by the Speaker, in 
   each case for consideration of such provisions as fall within the 
                jurisdiction of the committee concerned

                                 A BILL


 
    To amend title XVIII of the Social Security Act to increase the 
 proportion of charges Medicare recognizes for mental health services 
furnished to qualified Medicare beneficiaries who reside in congregate 
                              residences.

    Be it enacted by the Senate and House of Representatives of the 
United States of America in Congress assembled,

SECTION 1. INCREASE IN MEDICARE PAYMENT FOR MENTAL HEALTH SERVICES 
              PROVIDED TO QUALIFIED MEDICARE BENEFICIARIES WHO RESIDE 
              IN CONGREGATE RESIDENCES.

    (a) In General.--Section 1833(c) of the Social Security Act (42 
U.S.C. 1395l(c)) is amended--
            (1) by inserting ``(1)'' after ``(c)'';
            (2) by inserting ``subject to paragraph (2),'' after 
        ``Notwithstanding any other provision of this part,'';
            (3) by designating the second sentence as paragraph (3); 
        and
            (4) by inserting after the first sentence the following new 
        paragraph:
    ``(2) Paragraph (1) shall not apply in the case of an individual 
who has been determined to be a qualified medicare beneficiary (as 
defined in section 1905(p)(1)) who is residing in a skilled nursing 
facility, nursing facility, or custodial care facility.''.
    (b) Effective Date.--The amendments made by subsection (a) apply to 
services furnished on or after January 1, 2001.
