Congress has the power to enact this legislation pursuant to the following: Because the legislation would change the formula for government contracts on federal-aid highway and public construction transportation projects, it is authorized under clause 1 of section 8 of article 1 of the Constitution which states ``[t]he Congress shall have Power to lay and collect Taxes, Duties, Imposts and Excises, to pay the Debts and provide for the common Defence and general Welfare of the United States; but all Duties, Imposts and Excises shall be uniform throughout the United States.''
