  Mr. McGOVERN. Madam Speaker, when the Committee on Rules filed its 
report (H.

[[Page E73]]

Rept. 116-353) to accompany House Resolution 765, the Committee was 
unaware that the waiver of all points of order against consideration of 
the motion to concur in the Senate Amendment to H.R. 1158 included a 
waiver of Clause 10 of rule XXI, which prohibits consideration of a 
measure that has a net effect of increasing the deficit or reducing the 
surplus over the five- or 10-year period.
